Terms of Service for Done in Three

Welcome to Done in Three. By accessing or using our website, products, or services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before engaging with our services. If you do not agree with these Terms, do not use our services.

1. Services Provided

Done in Three specializes in rapid web design services, delivering projects within a 3 day timeframe. The scope of each project is outlined and agreed upon before work begins.

2. Client Responsibilities

You agree to provide accurate and complete project details, including content, images, and any necessary access credentials, at the outset of the project. Timely communication is essential to meet deadlines. Any delays in client responses may affect the delivery timeline.

3. Payment Terms

Full payment is required upfront unless otherwise agreed upon in writing. Once work has commenced, refunds are not guaranteed. Payment details and invoices will be provided at the time of project initiation.

4. Intellectual Property

a. Ownership of Deliverables: Upon full payment, ownership of the final deliverables is transferred to the client.

b. Retained Rights: Done in Three retains the right to showcase completed projects in our portfolio unless expressly prohibited by the client in writing.

5. Warranties and Limitations of Liability

a. Warranties: Our services are provided “as is” without warranties of any kind, whether express or implied.

b. Limitation of Liability: Done in Three will not be liable for indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the amount paid for the services rendered.

6. A2P Messaging Disclaimer

Done in Three uses Twilio’s A2P (Application-to-Person) 10DLC messaging system for client communications. By providing your phone number, you consent to receive messages from us. Standard messaging and data rates may apply. To opt out, reply with “STOP” to any message received.

7. Termination of Services

We reserve the right to terminate services if:

a. The client breaches these Terms.

b. Communication delays exceed five (5) business days without prior notice.

c. Payment terms are not met.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Nevada, without regard to its conflict of law principles.

9. Modifications to Terms

Done in Three reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of the revised Terms.

11. Additional Service Offering – 7-Day eCommerce Web Design Sprint

In addition to our primary service of delivering projects within a 3-day timeframe, Done in Three offers a separate service: a 7-day eCommerce web design sprint on Shopify.com.

This 7-day sprint is a standalone service and is not part of the core ‘Done in Three’ offer. It operates under distinct timelines, deliverables, and pricing structures. By engaging in the 7-day sprint, clients acknowledge that this service follows a different project scope and may require additional terms that will be outlined at the time of engagement.

All terms regarding payment, intellectual property, and liability remain applicable unless explicitly stated otherwise for this specific service.
